Terms of use

1. Definitions
In these Terms of Use, the below terms shall have the following meanings:
– Payment Confirmation: the payment confirmation You receive upon payment of the prescription fee, as requested by UHasselt.
– SKETCH ATLAS: the online educational platform for (blended) learning within specialized video tutorials on the topic of architectural sketching/envisioning, developed by UHasselt and made available at the Website.
– Terms of Use: the terms and conditions as set forth in these articles, with respect to Your use of SKETCH ATLAS.
– UHasselt: a public autonomous institution, operating under Belgian law, established at Martelarenlaan 42, 3500 Hasselt, Belgium, and with company number BE0208.359.859: https://www.uhasselt.be/en
– Website: the website on which SKETCH ATLAS is made available by UHasselt: https://sketchatlas.org.
– You: visitor of the Website.

2. General information
Consulting or using this Website implies Your full knowledge and acceptance of these Terms of Use.
The specific subscription of Your access to SKETCH ATLAS is described in more detail in the Payment Confirmation. The Payment Confirmation and these Terms of Use shall constitute the agreement between You and UHASSELT, to the exclusion of any other general terms and conditions (if any).

3. Account management
Any visitor of the Website can freely create an account if they are 18 years old or over and are legally competent to do so.
Access to Your account is strictly personal and is protected by a password which You need to keep secret, which is sufficiently strong and needs to be changed at regular intervals. You are not allowed to provide access to Your account or make it available to a third party in any way.

4. Availability and security
UHASSELT puts in the required efforts to ensure that SKETCH ATLAS is available over the chosen timespan, without being able to be held liable for interruptions, regardless of whether or not these are due to external factors or to its own actions/inactions.
UHASSELT offers You a reasonable level of support, but does not offer any guarantee with regard to availability.
UHASSELT provides maintenance to the best of its abilities, including adjustments and corrections of the Website. If possible, planned servicing will be announced in advance in case they have an impact on Your use of the Website. Urgent maintenance can take place without prior notice. It is possible that substantial functionalities of the Website are altered by UHASSELT, without You being allowed to object to this.
UHASSELT will go to great lengths to ensure the security of the Website, such as security surveys, coding techniques, secure environments and all measures and procedures that are reasonable according to the state of the art in this domain. In the event of an attack on the Website, information crime or any other unauthorized attempt to gain access to a part or the whole of the website, UHASSELT will use all legal means available to protect the integrity of its Website with the assistance of the competent authorities.

5. Intellectual property rights
The Website and SKETCH ATLAS in particular – including texts, layout, graphic components, graphical user interfaces, presentation, registered trademarks, logos, software, source code, databases, brands, and other components of the Website – are protected by intellectual property rights belonging exclusively to UHASSELT.
You are provided with a temporary login to SKETCH ATLAS for strictly personal use only. Any reproduction, dissemination, sale, distribution, publication, adaptation, translation, processing and use for commercial purposes of all or part of this Website, in any form or by any means whatsoever, is prohibited. The same applies to data that is not protected by intellectual rights, which can be collected, among other things, by means of the technique of ‘screen scraping’.
You will in no event (attempt to) disassemble, decompile, copy or reverse engineer the functions, content and/or design of SKETCH ATLAS.
UHASSELT reserves the right to take any and all measures it considers to be effective in order to prevent and/or stop the infringement of its intellectual property rights, without being held liable due to this measure.

6. Improper use
While using the Website and SKETCH ATLAS in particular, You are prohibited to perform acts that are in contravention of Belgian laws or any other applicable laws or rights of third parties. Should this be the case, UHASSELT is at all times entitled to report Your improper use to the relevant authorities.

7.Warranties and liabilities
SKETCH ATLAS is offered to You on an ‘as is’ basis. UHASSELT does not guarantee that SKETCH ATLAS or more generally Your use of the Website meets Your expectations. You will at all times remain responsible for Your use of SKETCH ATLAS or more generally the Website.
A device (pc, smartphone, tablet, etc.) is required to login to SKETCH ATLAS. UHASSELT cannot be held liable for any damage caused by the use of the device or for damage to the device itself.
UHASSELT cannot be held liable for Your intangible, indirect or consequential damages, or claims of third parties arising as a result of or in connection with Your use of the Website.
Without limiting the above, the contractual and non-contractual liability of UHASSELT to You is at all times limited to the lowest amount on the basis of the invoiced amounts, excluding VAT and other taxes, as mentioned on the Payment Confirmation. If no fee is paid to UHASSELT, the liability of UHASSELT is limited to 100 EUR (€100).
In any case, UHASSELT is not liable to You in case the damage is the result of force majeure.
In addition to compensation for which You are liable under applicable law or the conditions of these Terms of Use, You indemnify UHASSELT against all liabilities, damages, losses, costs and expenses (including legal costs and reasonable amounts paid in the execution of legal claims) suffered by UHASSELT or caused and directly or indirectly resulting from Your use of the Website and violation of these Terms of Use.

8.Changes to the Website and/or Terms of Use
UHASSELT reserves the right to modify or update the Website and SKETCH ATLAS in particular, at any time without prior notice. In addition, UHASSELT has the right to modify or update the Terms of Use. UHASSELT will not be liable for any adverse consequences that may arise from the changes made to the content of the Website or the Terms of use.
It is Your responsibility to ensure that You are aware of the most recent Terms of Use. UHASSELT reserves the right to change these Terms of Use at any time; provided the changes made are clearly published on the Website, thereby stating the version number.
These Terms of Use were last updated on June 17, 2022.

9. Miscellaneous
If one or more clauses of these Terms of Use are declared to be partially or completely void or non-binding by a legal intervention, it will not affect the validity of the remaining clauses or the validity of the entire Terms of Use. If UHASSELT wishes to amend or replace the clause(s) in question, the amended or new clause(s) is to be as closely as possible in line with the void or non-binding clause(s).
The failure of UHASSELT to demand a strict compliance with the provisions of these Terms of Use shall not be construed as any renouncement or rejection thereof.
All disputes relating to the validity, interpretation, enforcement, execution and termination of these Terms of Use shall be settled in accordance with Belgian law, excluding the private international law as far as it concerns referral. Only the competent courts of Hasselt (Belgium) will be able to take notice of such disputes that cannot be settled amicably between You and UHASSELT.
